REGULATION FOR THE OPERATION OF THE SHARED BICYCLE SYSTEM OF THE MUNICIPALITY OF PAIONIA

ARTICLE 1 – PREAMBLE

The Municipality of Paionia, through the present regulation, defines the terms of use and operation of the Shared Bicycle System, aiming both at the management and protection of municipal property by the Municipal Services and the citizens in the best possible manner, and at the clear articulation of users’ obligations and rights. This regulation specifies the system’s daily operating hours, the conditions and methods for obtaining user rights, the process and method of use, and explicitly states the users’ rights and obligations. Finally, it defines the usage fees and corresponding penalties for any violation, as well as the committee responsible for their imposition.

ARTICLE 2 - LEGAL FRAMEWORK

This regulation is issued pursuant to the provisions of Articles 75 and 79 of Law 3463/2006, as amended by paragraph 2 of Article 11 of Law 4674/2020 and the Royal Decree of 24/9–20/10/1958, and constitutes a regulatory administrative act having the force of substantive law.

ARTICLE 3 - GENERAL TERMS AND DEFINITIONS

• The term "Bike Sharing System (BSS)" refers to the system of shared bicycles implemented by the Municipality, which allows for the short-term use of bicycles, as described in detail in this Regulation.
• The term "Bicycle" refers to a bicycle with an aluminum frame, specially designed with anti-theft and anti-vandalism features, bearing a unique identification number and equipped with an integrated GPS/GPRS tracking system.
• The term "Rental Station» refers to the designated bicycle station that includes locking/charging docks.
• The term " Locking/Charging Dock" refers to a specific position at a Rental Station where a Bicycle is placed and securely locked.
• The term " Rental Terminal" refers to the touch-screen system through which a bicycle may be rented.
• The term "User" refers to any registered individual who uses the Bike Sharing System.
• The term "User Registration" refers to the process by which a natural person registers in the system, either through authentication via Taxisnet credentials or by submitting identification documents.

ARTICLE 4 - GENERAL DESCRIPTION OF THE SYSTEM

The system includes 30 electrical bicycles and 32 locking/charging docks. The stations bicycles are located at below positions within of urban city web:

1. Axioupoli : Pavlou Melas Square, Station with 5 locking/charging docks and 1 station charging system (Geographical latitude: 40°59'7.19"N, Geographical longitude: 22°32'26.08"E)
2. Goumenissa: Municipal Community of Goumenissa, Station with 6 locking/charging positions and 1 station charging system (Geographical latitude: 40°56'50.73"N, Geographical longitude: 22°27'21.80"E)
3. Polykastro : Polykastro Town Hall , Station with 8 locking/charging docks and 1 station charging system (Geographical latitude: 40°59'53.46"N, Geographical longitude: 22°34'11.87"E)
4. Polykastro : Central Square of Polykastro , Station with 8 locking/charging docks and 1 bicycle rental terminal (Geographical latitude: 40°59'41.48"N, Geographical longitude: 22°34'19.53"E)
5. Evropos : Station with 5 locking & charging docks and 1 station charging system (Geographical latitude: 40°53'46.45"N, Geographical

longitude 22°33'13.96"E)

ARTICLE 5 - REGISTRATION PROCEDURE AND ACCESS METHOD

Any citizen wishing to use the Shared Bicycle System (SBS) must first download the dedicated BikePaionia application and complete the registration process by providing the required personal details.
No financial reservation or payment is required, as all system functions are offered to citizens free of charge.

Subsequently, the user must select the preferred method of system access. There are two available options:

1. Through the use of the easyBike Paionia mobile application, available free of charge from the Google Play Store or the Apple App Store. When the user wishes to use a bicycle, they simply scan the QR code located on the bicycle.

The locking dock automatically releases the bicycle, and the rental period begins. The use of the mobile application is strictly personal.
It should be noted that user authentication is carried out through verification with Taxisnet credentials.

After the three (3) hours that users are entitled to use the bicycle, they must return it to any bicycle rack and secure it in an empty space. This will stop them from being charged for the bicycle. If for any reason they are unable to secure the bicycle in a space, they must contact the support desk immediately and return the bicycle in the manner indicated.

The operation of the service is only permitted to persons over 18 years of age , who are knowledgeable about the use of bicycles and who do not have any medical instructions contrary to their use (otherwise the Municipality bears no responsibility).

As mentioned above, the electronic account and the RFID card are strictly personal and are not transferable. Their holder is legally responsible and is committed from their present terms and in him attributed any liability for any damage or injury caused directly or indirectly by the use of the bicycle.

ARTICLE 6 - AVAILABILITY OF THE SERVICE

The maximum time for use of each bicycle is three (3) hours . In case of disagreement about the duration use of bicycle from the user, the alone reliable data are considered the data provided by the service's information system.

The service is available throughout the year, all week long, with operating hours as determined by decision of the Mayor. Operating Zone: The use of the System's Electric Bicycles is permitted exclusively within the Municipal Unit Boundaries where the Charging Stations are installed and in particular in the Municipal District of Axioupolis , Municipal District of Goumenissa , DE Evropos and in the DE Polykastro within the above Zone.

ARTICLE 7 - LIABILITIES OF PARTS

7.1    Liabilities of Municipality

The Municipality is committed to providing BikePaionia services , in accordance with the terms and conditions set forth herein.

7.2  Liabilities of user

ARTICLE 8 - RESTRICTIONS IN USE OF SERVICE

• The RFID card that is destroyed or lost through the user's responsibility will not be replaced, but the user may request the issuance of a new one in accordance with the prescribed procedure.
• The user is authorized to use the bicycle in accordance with these terms, as long as he makes a reasonable use, which mainly excludes: any use outside a predefined area, any use contrary to the provisions of the Highway Code or the rules safety, any use on land or in natural conditions that destroy the bicycle, the transport of any load over fifteen (15) kilos (including of space of basket), any passenger transport in any way, any use that could endanger the user or third parties, any disassembly or attempt dismantling all or part of the bicycle and in general any unorthodox use of a bicycle.

ARTICLE 9 - RESPONSIBILITIES AND STATEMENTS OF USER

ARTICLE 10 - RIGHTS OF MUNICIPALITY

ARTICLE 11 - PENALTIES

ARTICLE 12 - PROTECTION PERSONNEL DATA

The collection and further processing of personal data carried out in the context of the use and operation of the shared electric bike system by the Municipality is governed by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("General Data Protection Regulation") as well as Law 4624/2019: "Personal Data Protection Authority, implementing measures for Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (Government Gazette 137/A/29-8-2019), as in force.

Detailed information on the collection and processing of users' personal data is provided through the Personal Data Protection Notice included in Appendix I.

ARTICLE 13 - REGULATION ANTIDICTIONS

The user may file a complaint within a period of three (3) months from the date on which the events he/she is reporting took place. The present terms are subject in Greek legislation. ARTICLE 14 - TRIPLE-MEMBER COMMITTEE FOR THE DETECTION OF DAMAGES AND BICYCLE THEFT AND THE IMPOSITION OF FINES

ARTICLE 15 - MANAGEMENT OF THE SYSTEM

The operation and management of the bicycle park will be carried out in the name of the Municipality of Paionia through a contracted manager, who will undertake the maintenance of the bicycles. and of consumables, the redistribution of bicycles between of the stations, the telephone service support, the insurance of system and the general functioning of the MS.

GUARANTEED OPERATION AND INSURANCE COVERAGE

Within the framework of the guaranteed operation of the MS, insurance coverage of the system is provided for the duration of the guaranteed operation period, through a contract with an insurance company.

Coverage Object

The Civil Liability of the Insured as a renter of electric bicycles is covered for Bodily Injury or Death (including monetary compensation due to moral injury or mental suffering) or Material Damage caused to third parties by errors or negligence of the Insured as a natural person, as a result of an accident that occurs from the use thereof. The coverage includes the geographical limits within a radius of up to 5km from the boundaries of the Municipality.

The coverage also includes expenses that arise directly from the defense of third-party claims and relate exclusively to the covered risk.

Maximum Liability Coverage Limits Provided General Third Party Liability

Bodily Injury / Death of a Third Party per person: €30,000.00

Third party material damages: €15,000.00

Per loss-causing event (S.B. & Y.Z. total): €60,000.00

Maximum limit for the entire duration of the insurance: €120,000.00

Exemptions

For each damage and claim from: €100.00

Exceptions - Special Agreements / Coverage Conditions

The following conditions and exceptions are highlighted as General and Special Terms of the Civil Liability Insurance Policy:

• For the coverage to be valid, it must be proven that the bicycles were rented to an adult according to the age limits of 18 to 65 years.
• Riding by bicycle riders/users must be in accordance with road traffic rules.
• Personal accidents of participants are not covered.
• Accidents that occur while traveling by car, boat or air are not covered.
• Cyber Risk
• Any communicable disease or the fear or threat (actual or perceived as such) of a communicable disease, regardless of any other cause or event contributing simultaneously or in any other sequence to it and regardless of whether it has been classified as an epidemic or pandemic by the World Health Organization (WHO) and/or by the competent local Public Authorities of the country in which the damage/loss/claim was caused or declared. A communicable disease is defined as any infectious disease caused by an infectious agent that can be transmitted by any substance, means or agent from any organism to another organism, including but not limited to any form of Coronavirus or Influenza viruses , provided that the substance or agent includes, but not limited to a virus, bacterium, parasite or other organism or any variant thereof, whether considered living or not.

And/or

any illness, as a consequence of which, based on the instructions of the local Public Authorities of the country where the damage/loss/claim was caused or declared, it becomes mandatory:

• The adoption or implementation of measures, even preventive ones, which result in the restriction of the freedom of movement of people and/or animals (such as quarantine, prohibition of movement within national territory or from or to certain countries, etc.).
• And/or the adoption or implementation of measures by decision of the competent authorities, which result in the closure of businesses or public services.
• And/or the suspension or interruption of the insured 's activities .
• And/or the postponement, suspension or revocation of permission for collective activities.
